Warranty & Limitation of Liability

New Products
All new products sold by CTi Automation are subject to the terms of any and all original manufacturer's warranty (warranties) that may apply. CTi Automation provides no warranties regarding such new products, including we disclaim any warranty of merchantability, fitness for a particular purpose and/or non-infringement.

Pre-Owned Products
All pre-owned products sold by CTi Automation are warranted to our customer only and as follows: such products shall be free from material defect (under normal use, storage, handling, installation and other normal conditions) for a period of 12 months from the date of sale. Our obligation shall be limited to the repair or replacement, at our choice, of any such defective product (or part thereof as we determine) free of charge to our customer; if we decide that the product cannot be repaired or replaced, we shall credit your account with us in an amount equal to the sum you paid to us for it. Any warranty claim must be by written notice to us received before the end of the 12 month warranty period, together with return of the claimed defective product within this same period, and must include our RMA#.

Products are sold by CTi Automation with such warranties as may be extended by the manufacturer of the product(s), and there are no warranties for value added services, services bundled with the products, or other services provided by CTi Automation. Copies of the manufacturers' warranties are available prior to the purchase of products by contacting CTi Automation. CTi Automation makes no other warranties and any and all implied warranties of merchantability, title, and fitness for a particular purpose are here by disclaimed. Customer is responsible for installation and use in accordance with manufacturers' instructions and CTi Automation shall not be responsible for customer's improper selection of a product for a particular application or otherwise. No warranty will apply if the products are in any way altered or modified after delivery by CTi Automation.

Any cause of action against CTi Automation must be instituted within 1 year from the date of purchase or provision of the products or services. If CTi Automation provides Customer with advice, training, applications support, or other assistance which concern any products supplied hereunder, or any equipment, system or the like in which the product may be installed, CTi Automation's giving of such advice or assistance will not subject CTi Automation to any liability, whether based on contract, warranty, tort (including negligence) or other grounds. In order to maintain quality Customer service, CTi Automation may monitor or record telephone calls and other communications.
